Controlling Cleanup Costs

Cleaning up petroleum contamination costs money. If contamination is extensive or has reached the groundwater, remediation costs escalate.

The Colorado Petroleum Storage Tank Fund reimburses eligible applicants for allowable costs that arise directly from the performance of necessary corrective action to clean up petroleum contamination from eligible underground and aboveground petroleum storage tanks. If contamination levels at your site are below established cleanup levels, no costs are allowable. If contamination levels only slightly exceed established clean-up levels, work closely with your Division of Oil and Public Safety technical reviewer to make sure an activity is necessary before you authorize it.

No other single factor within the Fund applicant's control so significantly affects the cost, effectiveness and duration of the cleanup as the selection of an environmental consultant. Colorado's Petroleum Storage Tank Committee has adopted Reasonable Cost Guidelines. Costs above the rates established in the Reasonable Cost Guidelines will not be reimbursed unless the Petroleum Storage Tank Committee (not the Division of Oil and Public Safety) determines circumstances at the site justify the higher rate.

As part of the Reasonable Cost Guidelines, the Petroleum Storage Tank Committee has also implemented a voluntary environmental consultant registration program. Companies who register have agreed to comply with specific requirements. Among these are:

To provide to each client who may seek Fund reimbursement a copy of the Reasonable Cost Guidelines and Client Notification form MHN, advising that costs billed at rates exceeding those in the Guidelines may not be fully reimbursed.

To submit invoices that are compatible with the format established in the Guidelines.

To make every effort to comply with requirements for assessing and cleaning up petroleum contamination.
To employ at least one individual who has at least 5 years of qualifying experience and who meets minimum education, certification or licensing requirements.
