Consultant Program - General Overview Article 2, Part 1
2-1-1. INTRODUCTION
Choosing an environmental consultant is a serious responsibility. No other single
factor within the Fund Applicant's control will so significantly affect the cost, the
effectiveness, and the duration of the remediation project.
To assist persons in the consultant selection process, and to increase assurance that
reimbursement from Colorado's Petroleum Storage Tank Fund is for activities that are both
technologically and cost effective, the Division of Oil and Public Safety (OPS) has developed a
program to list environmental consulting companies and environmental scientists.
2-1-2. DISTRIBUTION OF CONSULTANT LIST
The list of participating environmental consulting companies is located on the
OPS webpage.
2-1-3. PROGRAM OVERVIEW
This is a voluntary program. No fee, testing, continuing education, proof of
insurance, or renewal is required. The requirements of the program apply only to
activities for which reimbursement is sought from Colorado's Petroleum Storage Tank Fund.
Listing is by company. To be eligible to participate, a company must employ at least
one person who qualifies as a Listed Environmental Scientist (see § 2-1-6 of the Guidelines).
2-1-4. NUMBERING
The OPS will issue a listing number to the company and separate listing numbers to
each environmental scientist.
2-1-5. ENVIRONMENTAL CONSULTING COMPANY
To become a listed environmental consulting company, a company must complete the
company form (at § 2-2 of the Guidelines), sign it before a notary public, and
return to the OPS with all appropriate attachments:
Properly completed individual environmental scientist form(s)
Company's quality assurance/quality control plan including SOPs for work
typically performed at petroleum release sites.
Company's health and safety plan
In signing the form, the company certifies its agreement to perform the following to
the best of its ability:
Abide by all federal, Colorado, and local statutes, ordinances, regulations, guidelines,
standards, practices, policies and other requirements pertaining to assessing and
remediating petroleum contamination in soil and water.
Notify the OPS within 30 days of any change in information provided on the form.
Comply with Colorado's Reasonable Cost Guidelines, including providing to any
client who may seek reimbursement from the Petroleum Storage Tank Fund a copy of the Guidelines
together with a signed "Client Notification" form MHN (at § 2-4 of the Guidelines)
showing that the client has been advised that any otherwise allowable costs billed at
rates exceeding those set forth in the Guidelines may not be reimbursed at a rate
higher than the Guidelines rate unless considered justified by the Petroleum
Storage Tank Committee, submitting invoices that are compatible with the format
established in the Guidelines, and not marking up materials or services provided by
any company or person with whom the listed company has a financial interest.
Ensure that all activities billed at labor rates for a principal, senior
engineer/scientist, project manager or project engineer/manager will be conducted by a
listed environmental scientist.
2-1-6. ENVIRONMENTAL SCIENTIST
To become a listed environmental scientist for Fund reimbursement purposes, a person must
complete the individual form (at § 2-3 of the Guidelines). To be eligible, a
person must meet the following minimum qualifications:
(a) Have at least five (5) years of qualifying experience and meet the
requirements of either (b)(1) or (b)(2):
(b)(1) Have a recognized professional license or certification such as professional
engineer, professional geologist, professional geological scientist;
- or -
(b)(2) Be a graduate of an institution of higher education that is accredited by a
regional or national accrediting agency, and have successfully completed at least 30
semester (45 quarter) hours of undergraduate work in one of the following: engineering;
biological, chemical, environmental, or physical science; or industrial hygiene.
If a listed environmental scientist leaves to form his/her own company, that company
must become listed with the OPS.
2-1-7. REVOCATION OF COMPANY LISTED STATUS
A company's listing status may be revoked by the Petroleum Storage Tank Committee for any
of the following reasons:
(a) It no longer has a listed environmental scientist on staff.
(b) It is convicted, enters into a plea agreement, or enters a plea of nolo contendere
to any crime involving a violation of Colorado or federal environmental laws and
regulations, including any violation of laws or regulations governing Colorado's Petroleum
Storage Tank Fund.
(c) It provides false information on any documents submitted to support a Fund
reimbursement application, such as technical reports, invoices, and affidavits of payment,
if the company had reason to know the information was false.
(d) It repeatedly violates any other provision on the listing application form to which
the company agreed by signing the form.
2-1-8. REVOCATION OF INDIVIDUAL LISTED STATUS
An individual's listed environmental scientist status may be revoked by the Petroleum
Storage Tank Committee for any of the following reasons:
(a) Providing false information on the listing application form regarding experience,
education, or professional licensing, if the individual had reason to know the information
was false.
(b) Conviction, entering into a plea agreement, or entering a plea of nolo contendere
to any crime involving a violation of Colorado or federal environmental laws and
regulations, including any violation of laws or regulations governing Colorado's Petroleum
Storage Tank Fund.
